GENERAL INFORMATION

• All prices on this site are listed in EUR and shipping is charged additionally. VAT may or may not be applicable based on your country of residence.

• Payments are handled securely through Stripe. PayPal* & Credit Cards are supported.

SECTION A: ORIGINAL ARTWORK PURCHASE

1. Shipping & Handling

• Original artworks are packaged and shipped within 3 to 5 business days of full payment, as they are already fully cured and might be varnished. "Might be varnished" specifically means that pieces which have gone through the adequate oil paint drying process of 6-12 months depending on layer application thickness - might have a final varnish applied which protects the paint underneath. You (the buyer) may request the information about the varnish and the procedure of varnishing with a proper final varnish if the painting is not yet varnished and if it was drying for over a year. You (the buyer) may negotiate the application of a "retouching varnish" that restores oil paint vibrancy if the painting is adequately dry to the touch before this full 6-12 month drying period passes since the retouching varnish still allows the oil paint to oxidize properly before the final proper varnish application.

2. Returns & Refunds (EU 14-Day Right of Withdrawal) (Is not applicable to artworks made as custom painting commissions - see section B of this page )

• Under EU law, you have the right to return an original physical artwork within 14 days of receiving it, for any reason.

• To initiate a return, you must contact me within this 14-day window after receiving the artwork (the original artwork that was listed for sale on this website).

• The buyer is responsible for all return shipping costs. The artwork must be returned in its original packaging, fully insured, and in the exact condition it was sent.

• Once I receive, inspect the artwork and confirm that it is not damaged, a full refund of the purchase price ( including initial shipping rate ) will be issued.

SECTION B: CUSTOM OIL PAINTING COMMISSIONS

1. The Commission Process & Revisions

• Once your commission request is accepted via the intake form and after the initial deposit, I will provide a rough composition sketch based on your ideas and/or provided reference photos that serve as inspiration.

• You are entitled to one (1) major revision during the sketch phase. During the sketch phase, you are entitled to one (1) major compositional revision and up to two (2) minor adjustments. Any further structural changes requested after this limit will incur a €50 (50 EUR ) revision fee per sketch correction.

• Once the sketch is approved by you, the painting enters the production phase. No further structural or compositional changes can be made once the oil painting process has begun.

2. Payments & The Non-Refundable Deposit

• A 50% non-refundable deposit is required to officially secure your commission slot and begin the sketching process.

• The remaining 50% balance, plus calculated shipping costs, is due upon completion of the painting, prior to shipment.

• The only exception to the "non-refundable" rule is in a situation where I am not able to complete painting the artwork due to some higher reason. In this instance where I am unable to finish the artwork, refund of any deposited funds will be issued.

• Prices are billed in EUR [or USD}.

3. Drying Times & Shipping Expectations

• Traditional oil painting requires significant drying time. Once the painting is finished, it requires approximately 3 to 5 weeks to become dry enough to touch and safe to package.

• The painting will be shipped unvarnished so the oil layers can continue to cure naturally over the next 6 to 12 months. An exact shipping timeline will be communicated to you upon final payment.

4. Return & Refund Policy (EU Directive Compliance)

• Custom Goods Exemption: Because this is a custom-made, personalized physical item, it is exempt from the standard EU 14-day right of withdrawal. All sales on custom commissions are final. I do not accept returns or issue refunds for "change of mind."

• Damaged in Transit: If the painting arrives damaged, you must contact me within 48 hours of delivery with clear, high resolution photographs of both the damaged artwork and the external packaging. I will work with you to repair the piece, re-paint it anew, or issue a partial or full refund depending on the severity of the courier damage.

5. Copyright & Ownership

• You own the physical original painting. However, as the artist, I (Marko Majetić) retain all copyright and reproduction rights. This includes prints and reproduction on merchandise such as cups, pillowcases, apparel and other products. Purchase of reproduction rights can be arranged through a separate contract and fees.

• I reserve the right to share images of the work-in-progress and the final painting on my social media, portfolio, and website unless a strict NDA or privacy request is agreed upon in writing beforehand.

• I will not reproduce or use in merchandise motives or subjects on the painting that can identify a person or motives which are or private nature.
